The terms on which Sampieri Racing accepts bets and operates telephone betting accounts.
These terms apply to every account we open and every bet we accept. By applying for an account you agree to them. If we accept your application, they form the agreement between you and the trustee for the M & P Sampieri Family Trust, trading as Sampieri Racing.
Where these terms conflict with the rules of racing or the requirements of our licence, those rules and requirements prevail.
To hold an account with us you must:
It is an offence to bet on behalf of a person under 18. If we find that an account holder is under 18 we will close the account immediately, void every bet placed on it, and refund the deposits made — no winnings are payable on a bet placed by a person under 18.
Applying does not create an account and does not oblige us to open one. We assess every application individually and we do not accept all of them.
We may decline an application without giving reasons, and there are circumstances in which we are prevented from giving reasons. A decline does not entitle you to compensation.
You must give us accurate and complete information. If information you have given us changes — your address, your contact details, your financial circumstances — you must tell us.
We must verify your identity before we accept a bet from you. We may also, at any time while your account is open:
These are obligations we carry under our licence and under the AML/CTF Act, not discretionary requests.
Bets are accepted by telephone only, from one hour before the first race in Victoria until the close of the meeting. We do not accept bets by email, text message or social media.
A bet is made when we confirm it to you on the call. Until we confirm it, no bet exists. If you are unsure whether a bet was accepted, ask before the event starts.
Telephone calls to our on course betting lines are recorded. We record them so that there is an accurate record of every bet placed, and so that a disagreement about a bet or a price can be resolved by listening to what was actually said. You will be told that a call is being recorded at the start of the call. If you do not wish to be recorded, we cannot accept a bet from you by telephone.
Recordings are treated as transaction records and are retained accordingly. Where a bet is disputed, the recording is the primary evidence we rely on, and we will make the relevant recording available to you on request.
You are responsible for bets placed on your account. Do not let anyone else use it.
We may refuse any bet, in whole or in part, and we need not give a reason.
Our maximum bet limits are $20,000 on metropolitan races and $5,000 on country races. Those are limits on what we will lay, not entitlements — we may accept less, and we may decline entirely. If you intend to bet at or near those limits, tell us before the day so we can be ready for it.
Where a bet is accepted at a price that is obviously wrong — a manifest or palpable error, including an error in a price we quote, a transposition, or a price that does not reflect the market at the time — we may void the bet or settle it at the correct price. We will tell you as soon as we identify an error, and we will not rely on this clause simply because a bet has gone against us.
Bets are settled in accordance with the rules of racing of the relevant controlling body, and with our own betting rules where those rules do not cover a matter.
This includes the treatment of:
Accounts are settled weekly after the weekend, or on a cycle arranged with you when the account is opened.
Funds deposited into an account must be turned over before they can be withdrawn. This is an anti-money-laundering control — it prevents a betting account being used to move money — rather than a betting requirement.
Credit is not offered when an account is opened. Any credit arrangement is entirely at our discretion, is available only to an established client, and is subject to the law applying to credit betting at the time. Nothing in these terms obliges us to offer credit or entitles you to it.
You can set a deposit limit on your account when it is opened or at any time afterwards. A request to reduce a limit takes effect immediately. A request to increase one is subject to a cooling-off period.
You can close your account at any time, for any reason. We will act on the request the same day it is made and we will not offer you anything to keep the account open.
We have adopted the Victorian Bookmakers' Association Responsible Gambling Code of Conduct. It is available at our Responsible Gambling page.
We may suspend or close an account where:
Where an account is closed, any remaining balance is paid out on the next settlement cycle, to an account in your name. We do not require you to bet the balance before it is returned, and closing an account does not forfeit funds.
Where an account has had no betting activity for 12 months and holds a balance, we will contact you at the last address and number you gave us to arrange its return. We do not charge dormancy or inactivity fees, and we do not absorb unclaimed balances. Where we cannot reach you, the balance is dealt with in accordance with the unclaimed money laws that apply.
If something goes wrong, tell us first — most matters are resolved on the phone the same day. Our full process, and the external escalation paths, are on our Complaints & Disputes page.
How we handle your personal information is set out in our Privacy Policy, which forms part of these terms.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where our liability can lawfully be limited, it is limited to resupplying the service or paying the cost of having it resupplied.
We are not liable for a failure or delay caused by something outside our reasonable control, including a telecommunications failure, a power failure, or the suspension or abandonment of a meeting.
We may change these terms. Where a change is material we will give account holders at least 14 days' notice before it takes effect. Continuing to bet with us after a change takes effect means you accept it. If you do not accept a change, you may close your account.
These terms are governed by the laws of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that state.
Chances are you're about to lose.
